audioers service allows all guest users to choose subscription who wish to become members or access only individual content of audioers streamed over the Internet to certain Internet-mobile devices over app, websites, computers and other hardware as guest users. Once subscribed to become a member or access audioers individual content, these Terms of Use govern the use of our service by you or your family or your peers.
As used in these Terms of Use, "audioers service", "audio service" or "streaming service" means the subscribed service or ad-hoc service for listening audioers content, including all features and functionalities, recommendations and reviews, the website, the apps and user interfaces, as well as all content and software associated with our service.
1.1. Your audioers membership once registered will always be there within our system and cannot be removed. You must have Internet access. Your access to proprietary content will continue until terminated being its membership user / ad-hoc paid user. To use the audioers service which are free, can be accessed without registration for promotional basis however ads will be paid to compensate the expenditures. However, if you are a paid user or, and provide us with one or more Payment Methods which may be updated from time to time, and which may include payment through your debit/credit or bank account with a third party. Unless you cancel your membership before your billing date, either reminder will be sent or you would authorize us to charge the membership fee for the next billing cycle to renew your account to retain membership and access to premium content.
1.2. audioers will have free plan / monthly / yearly membership plans, including gift cards with special promotional plans offered by collaborated companies in conjunction with the provision of their own products and services. audioers team cannot be held not responsible for the products and services provided by such collaborated companies.
1.3. Some special offers offered with conditions and limitations during promotion, will be made communications either through an email or notification about the limitation of the offer. Details pertaining to your account can be viewed by going into“My Account”link available at the footer.
2.1. audioers may start your subscription with a free account for promotional basis for a limited period of time to try the service. However, if you refer more users to the site and increase the number of users by referral service, we will be able to offer extension on the offer.
2.2. Free account limitations will determine by audioers team at its sole discretion and limit eligibility or duration to prevent free account abuse. audioers team reserve the right to revoke free account use and put your account on suspension if observed usage at more than one location or in the event of sharing usernames and passwords. Members who hold once paid account, will not be given any free account usage for promotional purposes. audioers may use information such as device ID, payment method, mobile number or used account email address used with an existing or audioers users to determine eligibility of extensions in case arises.
2.3. Membership fee once charged will not be returned back; Account details shouldn’t be shared with multiple users. More than 2 devices will result in suspension of your account and will be opened only if you clarify with grievancecell@audioers.com .
3.1. Billing Cycle: audioers service charges are prepaid in nature and will incur creating content, graphic representation and hosting services connection with your use of the streaming service, such as taxes and possible transaction fees, will be charged to your chosen Payment Method. The length of your billing cycle will depend on the type of subscription i.e., adhoc, monthly or yearly that you choose when you sign-up for the service. Visit our website and click on the "My Account" page to see your next payment date for renewal. We may authorize your Payment Method in anticipation of membership or service-related charges through various methods, including authorizing it for one time (ad-hoc service request) or approximately one month of service (monthly subscription service) or approximately one year of service (yearly subscription service) as soon as you register. Once registration is complete, there would no refund paid under no circumstances as we would be investing all the revenue in generating new content and streaming it over internet which is highly revenue oriented.
3.2.Payment Methods audioers service can be accessed by paying through payment gateway, bank transfer or redeeming of gift coupon. However, no cash transaction will be allowed. You authorize us to your subscription fee for delivering seamless streaming service for the payment done. If a payment gateway does not successfully settle within the stipulated time, due to expiration time, insufficient funds in bank, or otherwise some other unknown problem, for that you do not cancel your account, we might suspend your account access to the service until we have successfully received payment. For some Payment methods, the issuer card or bank might charge certain fee; such as foreign transaction fees or other related fees relating to the processing of payment method.
3.3. Cancellation: Every member has rights to cancel your audioers membership at any time which will leave your account in suspension however the unpaid amount will not be kept under suspension which will be expiring on stipulated time during payment; and you can continue to have access to the audioers service by paying the following membership amount anytime after suspension if entire amount is said to be expired. However, if the amount isn’t expired, you can use the services until the amount is expired. As per the permitted by the applicable law followed by international countries, payments are never non-refundable and do not provide refunds or credit transfer for any partial membership from one account to another or extension for future period under suspension or unheard audioers content. To suspend the account, go to the "Account" page, please send an email to info@audioers.com. If you would like to cancel the membership, account will auto close at the end of your stipulated billing period during payment. If you signed up for audioers using your account with a collaborative company special offer and wish to cancel your audioers membership, you may need to do so through by sending an email to info@audioers.com
3.4. Changes to Membership Plan & Subscription Plans: audioers reserve right to change subscription plans and the price of membership service / ad-hoc service from time to time; however, any price changes or changes to your subscription plans will apply.
4.1. audioers service might be offered to anyone who is 18 years of age, or the age of majority in your province, territory or country, to become a member of the audioers service. Minors who are lesser than 18 years of age, may only use the service under the supervision of any parent, adults.
4.2. audioers service and any content added within audioers are present within the service are for your personal and non-commercial use and may not be shared or banned for commercial listening unless authorized in written format. During your audioers membership we grant you a limited, non-exclusive, non-transferable right to access the audioers service and listen audioers content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public listening and performances in any format, which can be used for prosecution.
4.3. audioers content primarily produced all over the world by various artists and can be used over internet where ever you have established your account and only in geographic locations where we offer audioers service and have licensed such content. The content that may be available to listen will vary by geographic location and will change from time to time. The number of devices on which you may simultaneously listen is maximum 2 as per the plan.
4.4. audioers service, including the content list, is regularly updated for our members. In addition, we continually test various aspects of our service, including our website, apps, user interfaces, promotional features and availability of audioers content based on languages, genre and timer.
4.5. audioers content is available for temporary download within the app and offline listening on certain supported devices with audioers app.
4.6. audioers service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. You automatically agree not to archive, reproduce, distribute, modify, perform, publish, license, create derivative works from, offer for sale, or use (except as explicitly authorized in these Terms of Use) content and information contained on or obtained from or through the audioers service. You also agree not to: circumvent, remove, alter, deactivate, degrade or thwart any of the content protections in the audioers service; use any robot, spider, scraper or other automated means to access the audioers service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the audioers service; insert any code or product or manipulate the content of the audioers service in any way; or use any data mining, data gathering or extraction method. In addition, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the audioers service, including any software viruses or any other computer code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are engaged in illegal or fraudulent use of the service.
4.7. The quality of the audio within audioers content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. Default playback settings on cellular networks content. The minimum connection speed for 0.5 Mbps; however, we recommend a faster connection for improved audio quality. A download speed of at least 2.0 Mbps per stream is recommended to receive seamless content. You are responsible for all Internet access charges. 4.8. audioers software is developed by, or for, audiors and is designed to enable high quality audio compression and decompression on the fly content delivery through multimedia Internet devices. You acknowledge that the use of the service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the audioers and related third-party software.
The member who created the audioers account has access and control over the audioers main account that are used to access audioers service and is responsible for any activity that occurs through the audioers account. To maintain control over the account and to prevent anyone from unauthorized accessing the account, the Account Owner should maintain control over the audioers playable systems that are used to access the service and not reveal the password or details of the Payment Method associated with the account to anyone. You are also responsible for updating and maintaining the accuracy of the information you provide to us relating to your account. We can terminate your account or place your account on hold in order to protect you, audioers or our partners from identity theft or other fraudulent activity and replication of any content.
The audioers service is provided "as is" and without warranty or condition. In particular, our service may not be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or consumer protection rights that you may be entitled to under the laws of your country of residence.
8.1 Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of Bengaluru, India.
8.2 Unsolicited Materials: audioers does not accept unsolicited materials or ideas for audiors content and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to audioers.
8.3 Customer Support: To find more information about our service and its features or if you need assistance with your account, please visit the audioers Help Center on our website. In certain instances, Customer Service may best be able to assist you by using a remote access support tool through which we have full access to your computer. If you do not want us to have this access, you should not consent to support through the remote access tool, and we will assist you through other means. In the event of any conflict between these Terms of Use and information provided by Customer Support or other portions of our website, these Terms of Use will control.
8.4 Survival: If any provision or provisions of these Terms of Use shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
8.5 Changes to Terms of Use and Assignment: audioers may, from time to time, change these Terms of Use. audioers may assign or transfer our agreement with you including our associated rights and obligations at any time and you agree to cooperate with us in connection with such an assignment or transfer.
8.2 Electronic Communications: We will send you information relating to your account (e.g. payment authorizations, invoices, changes in password or Payment Method, confirmation messages, notices) in electronic form only, for example via emails to your email address provided during registration.
